(Per Article I, Section II of the Constitution, you do not have to be a Congressman to be Speaker although that is the tradition.). Probable no, technically legal yes. Since judges are usually much more resistant to political pressure or whims, one just need to look at the recent election-related rulings, they would almost certainly follow the law and extradite Trump if charged.
