Depending how long she has been in a NJP could provide to be a hurdle for re-enlisting.

If she was cut loose I will be she will show up in the media and be portrayed as a "woman sailor punished for her beliefs"
And if not, the right-wing media outlets are going to scream liberal bias. I really don’t think the leadership at NBVC, or anywhere, is likely to be very tolerant about being blatantly political in uniform these days given the current environment.

Depends on how the command wants to handle it. Looking at the MCM (which is apparently now online), I bet you could make a case to charge violation of Article 134, with one specification of disloyal statements (“Fuck Trump,”) one for disorderly conduct (Screaming and flipping off the crowd in uniform, which is service discrediting), and to dogpile, maybe another one of indecent language (swearing at a crowd in uniform, again service discrediting). Dunno if those last two are duplicative; the command might have to ask the JAG if it makes sense to plead both or pick one.

The disorderly conduct bit only can get confinement, but the disloyal statement and indecent language each ring up a possible punitive discharge under the MCM, which triggers eligibility for ADSEP for commission of a serious offense.

So if the command does want to cut bait, I’d bet she’s probably screwed.

To play the devil's advocate: How likely is it that this will be swept under the rug in our current political environment? I would imagine that her being a woman and already highly politically-focused, that any administrative action would trigger her to run to the press and raise a ruckus that does nothing but make the Navy look bad. The standard "I'm being discriminated against because I'm a woman and [insert race here] and [insert sexual orientation and gender identity here], yada yada yada."

I think if they punished her for flipping off the women that would be a way to avoid the Trump issue, if nothing is done it sets a bad example.

They could also wait for a few month for things to die down then take her to NJP.

I don’t think Aviation Boatswain Mate is a sexual orientation...but I haven’t been in uniform for a long time.

They could just punish her for breaking the oath to obey the President of the United States. Seems as though that oath isn't as legally binding as it used to be.

And there's a chance that her chain of command could be the sort who goes on to forums and calls people who support their Commander-in-Chief "cultists".

I know the prospect of reprising your role as squadron Legal Officer gives you a 4 hour boner, but scripting out all of this is really quite silly. Her command will handle it how they see fit. Let's leave it at that.

Sick of people scared to enforce standards because of the EO complaint threat.
I’ve had to take Sailors of all gender/race/orientation to mast, including two that punched all three demographics at the same time (POC/Female/LGBT) and several times had a Chief come to me concerned “if we press forward with this, they may file an EO complaint.”

My answer, every single time, was “they can feel free, make sure they do it in writing please.” When you hold everyone to the same standard, then all of the other details stop mattering.

I don’t care what you look like, who you fuck, or how you identify, the UCMJ is pretty straight forward...

I was just pointing out that ADSEP was probably an option on the table for the command’s consideration, contrary to the post I replied to . . . I’m not in charge there, so ¯\(ツ)/¯.
