So I have another question I wanted to bounce around. @NavyOffRec.
What is the precipitator to submit a legal waiver with an application?
Because my recruiter did a police record check on me that came back absolutely clean. HOWEVER, on my SF-86 the question where it asks, Have you EVER been arrested/charged I indicated that I did 15 years ago when I was 15 (which went to diversion and was not adjudicated). So because I indicated it, my recruiter will submit a legal waiver and my handwritten statement with my application package. I am terribly bummed about this as I think it will severely weaken my package, but what is the standard process when it comes to legal waivers? Is there one? Because my recruiter did not at all seem sure. Did I even NEED a legal waiver since the police record check was clean? idk..I would love insight

Here are the Police/Criminal Record questions on the SF-86. Not sure what your 15 year old self did. But If it didn't involve a felony, alcohol, drugs, firearms, or explosives then you didn't need to report it which means you don't need a legal waiver. Now based on your recruiter putting in a legal waiver after the board deadline I'm not sure if this means that your package gets pulled or not or if there is even a way to "pull back" a legal wavier. That would be a question for @NavyOffRec or @RecruitingGuru

- In the last seven (7) years have you been issued a summons, citation, or ticket to appear in court in a criminal proceeding against you? (Do not check if all the citations involved traffic infractions where the fine was less than $300 and did not include alcohol or drugs)
- In the last seven (7) years have you been arrested by any police officer, sheriff, marshal or any other type of law enforcement official?
- In the last seven (7) years have you been charged with, convicted of, or sentenced for a crime in any court? (Include all qualifying charges, convictions or sentences in any Federal, state, local, military, or non-U.S. court, even if previously listed on this form).
- In the last seven (7) years have you been or are you currently on probation or parole? - Are you currently on trial or awaiting a trial on criminal charges?
-Have you EVER been convicted in any court of the United States of a crime, sentenced to imprisonment for a term exceeding 1 year for that crime, and incarcerated as a result of that sentence for not less than 1 year? (Include all qualifying convictions in Federal, state, local, or military court, even if previously listed on this form)
  • Have you EVER been charged with any felony offense? (Include those under the Uniform Code of Military Justice and non-military/ civilian felony offenses)
  • Have you EVER been convicted of an offense involving domestic violence or a crime of violence (such as battery or assault) against your child, dependent, cohabitant, spouse or legally recognized civil union/domestic partner, former spouse or legally recognized civil union/ domestic partner, or someone with whom you share a child in common?
  • Have you EVER been charged with an offense involving firearms or explosives?
  • Have you EVER been charged with an offense involving alcohol or drugs?

this is the question I had to answer yes to. (long story short, worked as cashier changed a bunch of prices of items for friends)

I'm honestly in the same boat as you. I understand your situation more than you know. At this point what's done is done, it will take about 4-5 weeks to get the legal waiver approved. (which it will) You can't stress yourself out worrying about stuff that is outside your control. I had a heart to heart with my recruiter about the same concerns and he advised me that he still felt I had an extremely good chance at getting selected. At that point I also threw my hat in the ring for SWO as I want to be a naval officer above all else. People still get in with legal waivers its just something a lot of people don't openly talk about and discuss. You'd be surprised at how many people have DM'd me to ask me about my legal waiver experience and shared their own. Chin up and stay positive!

I hope the same can be said about my medical waiver. I’d hate if my honesty ruined the chances of getting selected. My medical waiver is for old childhood anxiety I had (dysfunctional family environment, toxic parent, etc :/) and sometimes during this application process it’s felt like a stain on my character, even though it wasn’t under my control. Hope everything works out of all of us!

The board does not see medical waivers. You will be fine!

At this point it's just a waiting game. Don't let it get you to flustered.

One thing in life I've learned man is that it's always best to be honest, and let god do the rest. What will be for you will be, and I got to take my own advice to. And @KristenQT im rooting for you just as much as im rooting for myself!

No matter what it was it will come up, I had a kid that was arrested when he was 13-15 (around that age), for attempting to shoplift a pack of gum, his punishment was some community service then and then it went away in diversion, or so he thought.

He never mentioned it to me and then when his initially background check was done everything came to a halt, they wanted to know why he didn't disclose the arrest, he wrote a letter of explanation but it delayed things a few weeks.

Depending on the agency it will depend on how much they release, some will release all with a PRC, some will only give convictions, some will only give info going back X amount of years.

I can tell you that in 99.99999% of the cases when the federal gov't runs the check it will show everything you did (including expunged, sealed, whatever) and it if wasn't disclosed it could be write a letter an continue to having Pro -Y turned to Pro - N.

I don't say 100% because once there was a kid that disclosed an arrest, it was a very small town, county police, 1 clerk, 1 judge. When I went to do the PRC nothing popped, we looked at the paper records and there was nothing, no record he was ever even in court. The response the clerk said was that sometimes if the kid made a single mistake and was overall a good kid that sometimes the judge would ensure that there was no record at all the kid was ever in trouble.
