Need Help (Legal)

So, my motorcycle was stolen 6 months ago (may 17th), and State Farm paid off the value of the vehicle, but I'm STILL trying to get the GAP insurance company to pay off the loan. The last document they need is a statement of the initial amount financed, FROM THE FINANCE company.

I've contacted the finance company every month for the last 6 months, requesting this document. they then refer me to an address for their correspondence office to mail them and request this information. I fax, AND mail them, but I never receive a response EVER. Their main office doesn't have a phone number for the correspondence office, and I can't find one either.

So basically, I call the company, they tell me to fax and mail this address, I do so, and receive no response. So I'm paying on a loan that has spiked its interest rate due to there no longer being collateral on it. Which is all too convenient and profitable for the company that won't give me this damn piece of paper.

Is there anything I can do to force them to give me this information, or force them to give me a phone number for this correspondence office? I don't know much about the freedom of information act, but can I use it to force them to give me this information?

Any help would be greatly appreciated as I am well beyond the point of despair, and I understand that nobody on here is giving me "legal advice or counsel", just some recommendations.

You could let the insurance company know that you will be in town next week and you will stop by and pick up the document personally because it's urgent. That approach has worked well for me. It's best if you have someone's name (or department name) where those documents are generated.

Good luck.

It'll be well worth it bro. Most lawyers will only charge a small fee.. about 1/2 or so of their hourly rate.

When you get into any sticky legal situation, a lawyer is a safe way to go. 300 now can save you shit tons later.

How about going to your legal assistance office on base?

Getting someone's name would be my recommendation. And call them! Over and over and over until it get resolved. Put yourself in their shoes. You'd probably get tired from hearing from the same guy every single day, so you'd make sure he got what he needed so he'd stop calling. A lawyer isn't going to be able to do much (except write a nasty letter) unless you have documentation proving you've tried and resolved the situation. Did you save the little reports fax machines print afterwards? I'd be surprised, most people (me included) don't. Have you sent any certified mail? Probably not. So I would start with a name and start building some documentation that you've been trying to contact the company.

State authorities might be able to help depending on what state you are in and what state the company is in. Where are you at?

Yes call the attorney general of the state you are in to report the company. This usually gets a quick response

FFSC helped me write a very nasty letter to one of the companies, and then made a very nasty phone call to the other company. It looks like I'm down to just one remaining document if all works out.
