"Milwaukee's police chief said he'll go on telling his officers to take down anyone with a firearm despite Van Hollen's finding that people can carry guns openly if they do it peacefully."

Since when can a police chief essentially ignore an AGs ruling that carrying a weapon isn't in and of itself a disturbance of the peace? More bullshit thrown on the Second Amendment. When did the Bill of Rights become shorter by 1?

This is backwards. The executive does not have to always enforce the judicial system, but the executive system can not "enforce" what the judicial deems legal.

"How it was explained to us is that if somebody calls and makes a complaint -- in other words, they feel threatened -- they feel it's causing a disturbance or they feel that it's disorderly in some fashion. They call us and we respond and we investigate it," a West Allis police officer said.

These stupid gum shoes need to do some reading instead of just listening to what their equally stupid police chief says. If someone was looking to cash in on a lawsuit, it would be a good time to go walking around with a gun on your hip in Wisconsin.

He said it may end up being a community-by-community, case-by-case issue fraught with the potential for danger.

No, dipshit. It's a state law. Maybe he should think about enforcing those laws instead of trying to maintain some kind of police state.

He said that means officers seeing anybody carrying a gun will put them on the ground, take the gun away and then decide if the person has a right to carry it.

What is next, if they see someone talking politics or religion they will jail them until it can be determined if they really have the right to freedom of speech?

From the standpoint that I take great care to conceal my handgun (hard to do with a full size 1911 and a small physique) when I carry I really cannot see the benifit of open carry. I really don't want the db that's trying to rob/hurt/kill me to know I have a gun until it's pointed at his noodle.

That out of the way,
Yes it's wrong for a police chief to go on record saying, "I'm going to ignore the law". It is also wrong to treat everyone as if they are criminals. It's just like you cannot be pulled over in your car because the officer just wants to see if you have a liscence.

It will not be long until the first lawsuit happens over this.

Wisconsin is one of only two states (the other being Illinois) that does not allow concealed carry. So if you want to carry concealed in Wisconsin (and are not a LEO), you have to break the law. That's why the AG explicitly saying open carry (the only option for Wisconsin residents) is legal is a big deal in principle. Of course, it looks like even the AG saying that won't stop people from being arrested for disorderly conduct.

I understand this issue is fraught with problems, of course...

It's a "May Issue" state, contingent on a Sherrif's signoff. It's actually not unheardof to get a CCW.

California?

Depends a lot on the locality, as CCW permits in CA are granted by Sheriffs and Police Chiefs. In some counties, it's very easy to obtain one- in others, not so much. All major population centers (LA, SF, and SD metro areas) fall in the "not so much" category.

Many of those "may issue" states are de facto no concealed carry. I believe the law in my native People's Democratic Republic of Maryland is federal officers, victims of assault within the last 90 days, and police officers can get a concealed carry permit. Everyone else is s.o.l.

Seeing how I was in San Diego, and getting one was impossible, that's what I was going by.

It's amazing how the right to "keep and bear arms" has been restricted to "keep a gun locked up in you house, as long as it can't hold more than 10 rounds, and don't think of ever moving around with it."

For example Hawaii is a may issue state, but no citizen has been issued a permit in the last 15 years. The police chief decided he does not want to issue any.

Illinois and Wisconsin have no provisions for a citizen to legally carry concealed.
