This brings back memories of McDonald's and the hot coffee. It's so so sad that as a country, we're effed-up enough that we need a disclaimer reminding us that "HOLY CRAP! Your coffee is hot inside this little styrofoam cup." Basically, this lady embodies everything, well a lot of things, that is wrong with this country.

Here's hoping that not only does the court laugh her out of the room, but that LOSER PAYS. VS shouldn't have to be paying attorneys for crap like this.

I was watching the Subway commercial the other day where the lady eats the five dollar bill. Under it there is a disclaimer warning people that eating currency is not safe or healthy and should not be done by others. All it does is mirror a culture that accommodates placing all of your responsibility onto someone else. It's always their fault, whoever they are, as long as they're not me.
Hell no. It might come out of the research and development budget. Lets keep those new products coming.
In most states, even if the "loser pays", it is usually only the court costs (chump change) incurred by the defense that get picked up by the plaintiff. The cost of an attorney to defend ones self is still paid by the sued party.
At my age when they take off that “R&D” stuff, well I’ll just say it can get really ugly.

You know the old saying... A thong in the eye is worth 2 on the bush.
That lawyer looks like a strip mall chode, and needs a swift kick in the throat. Something tells me everything on that woman is a thong.
Respectfully, there are two sides to the McDonalds coffee story. McDonalds systematically served coffee at 180+ degrees - a temperature that will cause 3rd degree burns in 3-12 seconds. This elderly lady received 3rd degree burns over 6% of her body, mainly on her genitals. She was hospitalized for 8 days and underwent skin grafts. She required two years of treatment. Bottom line - this was not a frivolous injury.
Everyone loves this story because of her 2.5 million dollar verdict - it is tossed around casually as an example of our legal system run amok. The rest of the story is that the trial court reduced her recovery to 640,000. She would later receive a lesser undisclosed amount after settling.
Even though this incident is held out as an egregious instance that typifies American tort law - perhaps it is more an example of corporate unresponsiveness. That lady initally only asked that her 11,000 medical bills be paid, to which McDonalds responded by offering her only 800.00.
