It's interesting to see that a law passed in 2005 would apply to a suit filed in 2000. I always thought that the law at the time the offence is what is relevant. For example, if a law were passed today legalizing murder, we wouldn't let all of the murderers out of jail because it was still illegal when the crime was committed.

I'm just speculating, this decision is absolutely the right one.
