If I were you I would just leave your employer and not address the matter - then see if they choose to sue. My experience with those clauses is it's rarely, if ever, enforcable - or even worth the effort to pursue litigation over.

As a youngster out of college I'm guessing it's some amount under $10K - I doubt very much it would ever be an issue.

Simply resign, don't discuss the issue if your employer brings it up - and get on with life in the Navy .

Yes, I paid the full second year.

Heres how I ended up breaking down the situation:

Case 1: I signed a contract and I should abide by it, word for word.

Case 2: The contract has a specific intent and purpose that doesn't necessarily apply to my individual circumstance, so maybe there is some way around it.

In the end, I decided that it was not worth fighting. There are a lot of people out there way worse off than I am and no one is taking away money that I don't already have in my bank (the repayment was deducted from the payout of unused vacation). In the end, I think that what constitues "fair" would be for me to pay the prorated amount for time not served. Though I ended up paying for the full year, I'll get by.

If you want to nitpick with the company ...

I'm pretty sure there is a clause in the Servicemembers Civil Relief Act that covers other contracts entered in to prior to joining the military, but I don't have time to look it up now. You can read it here.

This still might be a different situation, though - since you have $ from the company as part of the contract, not property that you can just return (car, apartment). Good luck.
