Car accident question

About 6 months ago the owner of the house across the street from mine backed into my truck and smashed the leftside of my front bumper. The estimated damage was $600. Being the idiot that I was, I agreed to settle under the table instead of through insurance. 6 months later he fails to return phone calls. We had even set up numerous meetings so I can pick up the check, but each time he fails to do so.

What are my options? I'm fed up with this game he's been playing and I'm tempted to go legal. Should I contact JAG? I just need help in getting started so I can get my money and fix my truck. Thanks to anyone who can help me :(

it should be interesting to try and get money if you don't have any paperwork about the accident since it's just your word against his, but I could be wrong...go ahead and call the JAG and see what they have to say.

Next time ..... call the police/insurance co. when it happens. Then burn his vehicle when you move :eek:. (kidding

Even if he paid you, it's still a bad idea to go under the table. It lets guys like him drive like a retard, and not let his insurance company know about it, which keeps him on the road.

Also, if he lives across the street from you, what prevented you from settling up then (at the time of accident)?

I recommend suing the guy in small claims court for $600.

Write down a record of all that has happened, pay $15 to file a suit and have him served.

Even if you don't win a judgement (which he won't pay of course) you gain a wealth of knowledge about the legal system.

Either win or stay where you're at.

Thanks Schnugg. This is the route I will be going. Already talked to Escambia County Small Claims and they identified it as a "spoken agreement." They said is wasnt to late to file a claim so Ill be doing that this week.

But I have copies of the estimated damage, photos and 2 witnesses. I guess it comes down to the judge.

Probably won't be a "judge" ... this ain't TV .... no ratings to work for .... but go for it.

QUESTION: Is the time/hassle worth $6 bills??? .... that's the question. If so, do it. If not, do something nasty when you move .... (j/k for all you uptight NAZI's) :)
