Arkansas

Huh, who would have thought that their would be a mildly fascist town in Arkansas. I would think that the citizens would find this sort of action pretty much the opposite of good.

I'm sure that there are a lot of situations just like this one nationwide. These guys (City Council) finally had the balls to do something about it. When the bad guys get to this point it's time to do something about it, ACLU be damned. I'd wager that if all the honest citizens were polled they would heartily agree with the council's actions. JMHO

On edit: AJB37, WTF is "Fascist" about taking common sense steps to protect the citizens??? Let's just these goobers run wild in the streets, sell their dope and generally commit mayhem... wouldn't want anyone to get their feelings hurt...:icon_rage

Not knowing the whole story, I will give them the benefit of the doubt, but I liked this quote from the local Mayor:

"The citizens deserve peace, that some infringement on constitutional rights is OK and we have not violated anything as far as the Constitution."

So did you or didn't you? :)

The illegal searches, 24 hour curfews, the idea the Constitutional rights can be taken from law abiding which punishes all for the actions of the few. Basically the whole Orwellian police state vibe I get from the article...

It's a fine line to be sure. There's someone on AW with the perfect quote for this situation in their signature, though I can't remember who.

I didn't get that from the several articles I have seen on the subject. Granted, there is room for abuse but what I am seeing is "If you're on the street at 3 a.m., we're going to take a look at you." Like I always told my teenagers, "Nothing good is going on after midnight and you don't need to be out there lookin' for it."

Most of the town agreed to it anyways. The whole city council voted in favor for it. They aren't saying these are just regular criminals, they are catching guys with assault rifles. from the map provided, they look pretty close to Memphis(so they might be getting spill over in crime activity). Not sure how to look at it, but there might be interesting consequences if people (ACLU) take them to court.

My main problem with the town's strategy is that they went authoritarian without regard for the end result. The article points out that many of the people arrested are likely to be released because of the illegal searches that resulted in their arrests.

AP Article said:
However, such stops likely violate residents' constitutional rights to freely assemble and protections against unreasonable police searches, said Holly Dickson, a lawyer for the ACLU of Arkansas who addressed the council at its packed Tuesday meeting. Because of that, Dickson said any convictions coming from the arrests likely would be overturned.

The town will have to release the drug dealers and other assorted criminals who will go back to doing the same thing they were doing before the arrest. All that this is going to do is have a negative effect on the citizens who follow the law, they will feel the biggest impact from the curfew and increased police presence and searches.

Except they are now doing this all day long. Does nothing but trouble also happen at 2 pm?

The other issue here is that if people are arrested when illegal drugs or weapons are found in searches of their cars, if those searches are ruled unconstitutional, won't they most likely just go free anyway? So this will have accomplished nothing. I am sure the police and citizens there are frustrated and desperate, but there is a great chance that all this will just end up not taking a single criminal off the streets permanently once all is said and done. Even if the citizens don't complain, the criminals have a right to and even the most pathetic of public defenders is going to have a field day with the searches.

I don't care if the whole state of Arkansas agreed to and passed a law that violated a specific principle in the US Constitution; it is still never ok to do that.

:nods

Me thinks some people would feel differently if we were talking about the whole community or state agreeing to...say... ban all gun ownership. ;)
