If you want to say every year's check bought them one more year, I'm only paid through 1 JAN 2012. I'm owed for January & February. Contract also stipulated that I would be paid $20,833 every January until I failed to screen for DH, removed myself from consideration, refused DH orders, or received my entire $125k via 6 payments.

They are trying to invoke Title X, USC, of which I have read the section, and I don't agree with their interpretation of it. Neither did JAG, but they can't help me sue for it.

Was there anything in the contract about partial payment? From what I saw it was all or nothing, no partial payments. If you weren't going to serve the full year you don't get the payment.

What was the basis of your discharge? FOSx2? If so, there's a clause in the program verbiage about that and having to make the continuation board. What part of Title X are they citing?

Had a LT work for me in skeds in NMM... great pilot, instructor, beer die player... requested to be ranked low on fitreps, didn't make O-4, got the~ 70K severence check while getting picked up with SWA. Affiliated with VR as a selres for a 10K signing bonus... what a deal (we give bonuses to dudes who don't make O-4!!!)

MB, did you get a severance check?? (maybe already covered). If not, why not?

I'm supposed to get one. Haven't seen it yet. It's really only a "loan" if you go SELRES and retire.
