As they end up on the deck the eagle uses a nose high maneuver to lose some energy and cut across the two circle fight. The seagull never tries to get out of plane or phase while defensive and instead he tries to bug out in a straight line, ultimately giving the eagle his control zone.

The eagle pulls a little lead, adds some power, and gets an easy talons kill.

Several years ago had an opportunity to attend novice Falconry training here in Arizona As part of the training we went on a hunt in the desert with Hawks and falcons, I was amazed to watch a Harris Hawk beaten by a rabbit. The Hawk was at the bottom of his stoop at high speed attempting a high 6 o'clock grab when the jenking rabbit made a quick reversal to downwind, the hawk couldn't hack the turn fluttered a bit, and then just beat his wings back to altitude as the rabbit escaped. The master falconers said they see that behavior frequently, including in dove and quail when pursued by falcons. Was a great experience.
