SCRA (Servicemember Civil Relief Act) for Terminating a Motor Vehicle Lease

Hello all,

(Sorry in advance if this isn't the right part of the forum to post this.)

I am expecting to hear back from my recruiter this month. I would need to terminate my car lease before OCS; I have searched the forums and have found some discussion on that, but nothing too detailed or elaborate. (link) (link) (link)

My question has to do with current ship-out dates after hearing back from your recruiter: looks like we might be waiting 5-6 months between hearing back and shipping out.

Will the car dealer/leasing agency give us any grief for trying to terminate the lease when the ship-out date may not be for several months? Part of the needed documentation will be the military orders, which will have a date pretty far into the future I guess.

Here's some information for you.

According to that article, you'll need to request your lease termination with a written copy of your orders. It's been a few years since I went to OCS but I remember getting my orders a few weeks prior to my class date so that doesn't give you a ton of time to work with the leasing agency to get the lease cancelled.

If your lease is not terminated prior to OCS, let your class team know and they should provide you periodic access to your phone or email to get it resolved. With that said, I would do everything you can to get it resolved before classing up. You don't want any unnecessary distractions.

I understand that you didn't have much time. My post was about having "too much time."

As in, will they say "we'll only officially terminate your lease just before your shop-out date" or something like that?

As far as I know, they have to cancel it when you provide proper notification. You are only financially responsible till the day you provided notification.

I realize the situations are slightly different but I cancelled a lease using SCRA when I got PCS orders overseas. I got actual orders in May but didn’t physically move until August. I turned the car back in about a week after I got orders, and I didn’t hear anything else about it.
