It's almost never purely any one party's fault. If you had power and steering, and you get hit or hit someone, it's at least partially your fault.
Collision just outside oil terminal minutes after separation from the tug and, evidently, still with the pilot at the conn on the tanker's bridge. Total mess in itself, demanding full SA from the Master, while frigate might went in entrance channel with little margin for elusive maneuvers... Add fog and darkness... et voila...
Yet you are right, there always is something to do.
