Great thanks all. My package has moved up the chain of appeals far enough that I have a long wait time between reviews. Believe it or not my orders out were cut 6 hours before the beginning of the acceptable window so I was initially denied and have since appealed with an ordmod I found later.

Great to hear it is at least still alive for the time being and fingers crossed for everyone waiting on the 2012 extension!

One question that I have not received a straight answer for is do I need to bring the loss of money to the table in closing, i.e. if my house is $40K under water, do I need to bring $40K to the table at closing? No kidding, since I first looked into the program last summer, my house slides $1K a month, swallowing up the entire mortgage payment with it.

My house in FL is at 34% of the peak price and 50% of what I paid for it.. Painful to watch, but at least it's rented for more than the mortgage payment.

Is the house in your name, or hers? If the house is in her name and you are just legally required to pay the mortgage, that might make it difficult to qualify, since that would mean she owns the house and it the one selling it, not you. <---not an expert, just spitballing

It's in my name, but she got the deed (illegally) put in her name, which the courts fixed.

I'm keeping it as a rental. I tried HAP, jumped through all the hoops, and was told "maybe", then "no" because of the changed deed status, even though it was done illegally (forged my signature, court reversed it).

And the appeal process? It's the bureaucracy to end all.

Casey, I tried the HAP route with Casa Fester in P'cola. It had all the efficiency and user-friendliness of a root canal at the DMV done by a postal worker, and the final answer was "no". In the end, we went for a short sale, $80K less than we owed. The bank went for it because we had a VA loan, so in the end the bank will get its money from the gummint. Fucks your credit rating for a few years, and ties up your VA guarantee for another house, but it's the least-shitty option of a plate of shitty options.

Not true. I asked that question of DSS and was told, "If we yanked the clearance of everyone having house problems, we wouldn't have enough people with clearances to get any work done."

If you're doing a short sale because your backyard meth lab screwed the home's value, or are being foreclosed because you gave the mortgage money to strippers and slow ponies, that's another thing. But getting out from under a house because the market tanked is not considered indicative of poor reliability.

I'm lucky that I bought small enough that the mortgage is $640 or so, so I can rent it and still clear enough to pay for maintenance.

Lucky for me, I got the Manatee out, and it fixed up about 2 months before my parents retired to FL. They rented it.

Upside they pay, and don't trash it.

Downside, I hear about every little friggin thing that's wrong. "did you know the paint does not totally match in the living room at 3pm when the sun comes through the skylights"....

What did she do, forge your signature on a quitclaim deed? Any legal repercussions for her on that?

Yep. That's what she did. Just got a yelling at by the court. No fine or jail.

Also recently took out a home equity loan against my VA house for $125,000.

Didn't close, but got close. Was using a shopped photocopy of my name and birthday on her license, but said she did not have original and lost it when she went to close.

Now has a bench warrant out for bank fraud, but until she gets stopped or arrested for something else, she's low on their list.
