Being altered doesn’t mean a cop gets to execute you. I presume the prosecution will be persuasive on that point.
not what I meant at all, referring to things like unknown heart or other issues, that combined with all factors caused a death, which could bring up reasonable doubt that the technique by itself would result in a murder conviction, which is a high standard.

The preliminary ME report states that "no physical findings that support a diagnosis of traumatic asphyxia or strangulation".

I also don't agree with the technique that was used.

To be fair, you deserve to be a bit pissed. The senior officer you encountered was, by almost any measure, “the” senior representative of the US Navy. What happened surely stung and yes, it is something I don’t routinely encounter in life. The point I hope we all get in life is that one asshole (or even a bunch) doesn’t make an entire team deplorable. In your case I hope they caught up with the guy, I hope he outed himself in some stupid way.
Said officer is still around. That’s okay. Over time I actually changed my view of being super pissed to feeling bad for him. Being an adult and thinking like that?? I actually ran into him when I was a staff officer at a COCOM right before I left active duty.

When I interviewed for a job following leaving active one of the interviewers asked me what one of my biggest regrets professionally was. I mentioned being to scared to say anything to the guy when his comment deeply hurt me because I was young and scared of what it would do to my officer career.

still bugs me I didn’t say anything.

What I love about the Navy is on Friday afternoon you see bangers, bikers, rednecks, nerds, preppies, grease monkies, country clubbers, and who knows what else heading out the gate, and you ask yourself, all these folks actually work together?

Why yes...yes they do.

Fair enough, though most of us on the aviation side are used to the term "toxicology report" meaning a substance use/abuse test post mishap or post mortem. In other words, nothing close to being a test for heart issues.

ah, that makes sense.

some more info has come out from additional witness statements on what the victim and former officer had said, and last night I read an interview (so to speak), where a defense attorney and former prosecutor broke down the case point by point on what the former officer was charged with, since witness statements are saying the victim was saying he couldn't breath before he was put on the ground it shows he was having a medical situation before he was put on the ground.

This of course does not excuse the fact that they took no action when they saw him become unresponsive to save his life.

I can't help but think if when he became unresponsive if they started lifesaving measures this wouldn't have reached the level it has.

Is race and ethnicity taken into account during promotions?
Why would it need to be on a fitrep?
Officially, no, but each voting member of a promotion board may deal with that according to their personal idiosyncrasies.

I’d say it’s probably a “consideration.”

Recruiters have quotas for minorities. I had a Hispanic recruiter tell me that he would have to send white prospects away because they only had room for minority officer candidates.

Our Company CO at TBS told us race is a “consideration” for combat arms MOS selection.

So, why not promotion?

Beside the fact that quotas are prohibited by instruction, there’s really no mechanism in how the board votes for something like that to be possible. I don’t know how the Marines do their boards, but I presume it’s similar. For all of the legitimate criticisms one might level at NPC, the promotion and screen boards are things they are very serious about ensuring fairness.
